无过错责任，垄断资本主义时期各种社会问题日益突出，工业损害，环境污染，产品致损等现象大量存在，传统的过错原则使此类侵权难以举证和认定，为了使受害人能够得到合理的补偿，出现了所谓的无过错责任，即在特定的情况下，即使行为人没有过错，也要承担损害赔偿责任。但这里有一个逻辑上的悖论：在行为人没有过错时，我们以什么理由要求他承担责任呢？事实上，无过错责任只是立法者对特殊情况的一种技术处理：一方面，此类情况出现频率高，过错举证困难，不给受害人以补偿有违公平；另一方面，此类过错专业行强，难以抽象出共同的标准，不以过错为要件也是效率的要求。况且，无过失并非指行为本身无过失，而是不以确定的过失为侵权行为构成要件，而不以过失为要件的原因不是对过失的否定，只是法律已形成对过失的推定，所以不必再去考虑过失的具体形式。[15]
严格地说，无过错责任并不能作为一种归责原则与过错责任并列。其真正作用不是解决责任的归属，而是解决损失的分担。其在立法上的表现也以列举式的规定出现，事实上也 是作为了过错责任的例外情况。由于侵权行为法是将法律调整的视野局限在一对一的责任归属争执之中。所以，当依侵权法的过错归责一方不应承担责任，而另一方又确属无辜并值得同情时，无法找到一个两全其美的办法。这在工业事故上表现尤其明显。受私法公法化理论影响，既然社会选择了工业化，受益于工业化，那么由社会承担损害后果也是理所应当。用王卫国教授的话说，致损风险是工业化的必然成本。[16]既然只是为了分配损失，那就必然要选择有能力承担损失的人，即所谓的“大钱袋（deep pocket）”理论。因为它们不仅本身有负担能力，更重要的是，它们有提供保险金的能力，即将损失分担社会化。这样，就有效弥补了侵权行为法自身的缺陷。但无过错的适用必须限定在一定范围内，特别是不宜适用于自然人之间的侵权行为。因为这会导致人们对自己的行为感到无所适从：不知道如何才能不承担责任。而当履行义务的成本过高时，往往会走向它的反面-不履行任何注意义务。这就如同一座设置不合理的人行天桥，为了方便人们甘冒风险。

这一过程是近代理性哲学在法律上的体现。自由资本主义的生产方式为我们带来了个人主义和自由主义的思想。“每一个人，在他不违反正义的法律时，都应听任其完全自由，让他采用自己的方法，追求自己的利益，”[6]“自由就是指有权从事一切无害于他人的行为。因此，各人的自然权利的行使，只以保证社会上其他成员能享有同样权利为限制。此等限制权得由法律规定之。”[7]由此，损害赔偿这一法律关系，也必须是当事人主观意志的结果。正如黑格尔在《法哲学原理》中所说，道德意志只承认对出于它的意向或故意的行为负责任。“行动只有作为意志的过错才能归责于我。”“毕竟我只是与我的自由相关，而我的意志仅以我知道自已所作的事为限，才对所为负责。”[8]康德在此问题上的阐释同样精辟，足以为过错观念存在的支撑。在他看来，行为是自由意志的结果，每个有自由意志的人应对其过错行为负责。人是一种自由的道德的力量，他能够在善与恶之间作出选择。康德认为：对行为的责难，应以理性的法则为基础，理性是完全自由的，而行为就应该由个人的疏忽负责。[9]所以，应从理性世界、从内心意志出发来评价过失。同时，法律上的过失责任又是对滥用自由的制约，其价值在于协调人们之间的意志和意志自由。“一个人和别人相处时必然会滥用他的自由”。[10]法律正是以否定的、强制的形式限制个人的滥用自由的行动。在此，我们再一次看到了过错概念的魅力，将权利行使的自由与合理完美结合，体现了理性与正义。
