With reference to our order No. W 98, the 120 computer sets supplies to the above order were delivered the day before yesterday, but we regret that 20 sets were badly damaged.
The packages containing the computer sets appeared to be in good condition and we accepted and signed for them without question. We unpacked the computer sets with care and can only assume that damage must be due to careless handling at some stage prior to packing.
We shall be glad if you will replace all 20 sets as soon as possible. Meanwhile, we have put the damaged computer sets aside in case you need them to support a claim on your suppliers for compensation.

我们的购房合同上明明规定：该商品房经综合验收合格后才能交付使用，根据郑州市政府的有关规定该商品房经五大主体验收后报市建委，市建委发放竣工验收备案文件才算综合验收合格。根据建设部《房屋建筑工程和市政基础设施工程竣工验收备案管理暂行办法》的规定，开发商应当自竣工验收合格之日起15日内，向工程所在地的县级以上地方人民政府建设行政主管部门(以下简称备案机关备案。备案机关收到开发商报送的齐全的竣工验收备案文件后，向其发放该商品房的《建设工程竣工验收备案表》。而且相关法规还规定建设工程收合格的，方可交付使用。但是在不具备交房条件的情况下自8月xx开始开发商已经陆陆续续交付了20多户，而且还在偷偷交付那些不知情的业主，记者多次去采访，追问他们为什么在没有备案表的情况下交了房子，他们总把责任推到业主身上，说是业主强力要求交房的，事实上是大部分业主都不太懂交房的手续，当听到他们电话通知说房子好了，就过去把房子收了，有些懂点法律知识的就没有接他们的房子而是开始投诉，8月xx开始通知业主收房，当时连五大主体验收的材料也没有，而且当时楼盘被施工方包围(听施工方说是开发商欠他们的工钱我们业主根本进不了房子，直到9月xx号我们才在售楼部看见一份复印的五大主体验收资料，但谁也没有见到过《竣工验收备案表》。没有《竣工验收备案表》，我们难免怀疑房屋质量有问题，而且很担心房产证办不下来

I am happy that the refrigerator we ordered last week has arrived on time. But it is a great pity that we find there is something wrong with the refrigeration facilities.
After we used it for several days. we found that food stored in the refrigerating compartment turned bad quickly. When we finally decided to take the temperature in it, we were surprised to find it was around 15℃, far from the standard temperture range from 0℃ to 9℃.

通观整个合同内容，存在严重的不平等现象。模糊条款和霸王条款都存在，业主违约要交付总房款万分之一的违约金，而在同等条件下开发商违约却只付总房款万分之0.5的违约金;关于收房时房屋达到的标准规定过于模糊，地下室安装门和单元房门的对讲机都没有在合同中规定，开发商解释说既然合同没有规定那他们理解就是没有，但我们业主理解附件对于主体工程来说就象上衣和扣子的关系，我们不可能买一件没有口子的上衣。
