The packages containing the computer sets appeared to be in good condition and we accepted and signed for them without question. We unpacked the computer sets with care and can only assume that damage must be due to careless handling at some stage prior to packing.
We shall be glad if you will replace all 20 sets as soon as possible. Meanwhile, we have put the damaged computer sets aside in case you need them to support a claim on your suppliers for compensation.

你们好!我们是xxxx置业有限公司开发的“xx公寓”5号楼的业主。三年前甚至四年前我们拿出积攒了十几年的积蓄,想在“xx公寓”为自己营造一个温馨、幸福的家,更多的业主还是依赖银行贷款,背负十几年甚至二十几年的债务才购置的住宅。经过漫长的等待,大家终于迎来了竣工交房的日子。然而,当广大业主兴高采烈、欢欣鼓舞的准备收房时,却被房屋质量、房屋验收、提前2----3年收走的房屋维修基金未向房产局交纳而被开发商挪用等一系列问题泼了一大盆凉水,其当头一棒的打击令很多第一次购房的业主、一辈子供一套房的业主几乎完全失去了对房产市场的信任。
此后,我们去房产局进行了投诉并与开发商多次的交涉过程中,尽管解决了一些问题(比如,维修基金上交,但就房产最重要的问题房屋验收备案却迟迟没有。无论是站在业主的立场还是站在企业的立场,甚至是站在政府和社会的立场,我们都希望房产市场能够健康和谐的向前发展,毕竟作为国家的十大支柱产业之一,房地产每年为国家创造的社会财富是不可估量的,其产生的稳定社会的作用也是不可忽视的,正如一位哲人曾经说过的:住宅是缔造人类社会和谐安定的基石。因此秉承对自己负责、对企业负责、对社会负责的纳税人的理念,我们有义务也有必要,在无计可施的情况下把问题向政府反映,希望政府及其下属各相关职能部门能出面协调,从维护社会安定的大局出发,从建设规范的房地产市场的国家政策出发,从协助消费者维护自己的正当权益出发,将“xx公寓”真正建设成一个业主向往的幸福、温馨的美好家园。
存在的问题如下:
移交钥匙时开发商让交了如下费用:垃圾清运费:300元;装修押金:xx00元;一年的物业管理费(按每平方0.2元收的;单元房门的对讲机费用:180元;电话初装费:58元;有线电视初装费:265元。当时开发商没有主动出示市物价局的收费许可证,所以我们也不知道他们有没有收垃圾清运费和屋业管理费等的权利。另外垃圾清运费和装修押金的收据都开成装修押金只是口头说1300元中有300的垃圾清运费,将来不再退回。

On September 10, our order for 280 women's cotton sweaters was duly received, but we regret to say that 40 cotton sweaters in white color were seriously soiled.
We had the case investigated immediately, and the result shows the damage was due to improper packing, for which the suppliers are definitely responsible.

通观整个合同内容,存在严重的不平等现象。模糊条款和霸王条款都存在,业主违约要交付总房款万分之一的违约金,而在同等条件下开发商违约却只付总房款万分之0.5的违约金;关于收房时房屋达到的标准规定过于模糊,地下室安装门和单元房门的对讲机都没有在合同中规定,开发商解释说既然合同没有规定那他们理解就是没有,但我们业主理解附件对于主体工程来说就象上衣和扣子的关系,我们不可能买一件没有口子的上衣。
