二、国外电视节目版式的保护
世界知识产权组织指出，电视节目版式的保护，尚未作为世界知识产权组织讨论的主题。但在现实中，有关电视节目版式的判例和非政府组织的文件，以及市场力量都对电视节目版式的知识产权属性进行了积极保护。意大利版权法目前正在修订，考虑到电视节目版式巨大的经济价值以及制作成本，决定把电视节目版式列为保护客体。巴西和法国等国家通过反不正当竞争法来保护电视节目版式，澳大利亚主要通过合同形式的专营权或牌照进行保护。国际范围内大量关于电视节目版式的司法判例对电视节目版式进行了较强的保护。著名的CBS诉ABC电视节目版式侵权案的审理，法院依据“实质性相似”和“接触”原则对两个节目版式进行了对比分析。所谓“实质性相似”是指被告的作品与原告作品存在着实质性的相似。“接触”原则是指原告的作品可为公众接触获得，作品已经出版，或由于与原告有其他关系而使被告有机会获得原告的作品。此案所运用的两原则是美国司法实践中最常用的著作权侵权认定标准，美国的司法实践有将电视节目版式纳入版权保护范围的趋势。
三、对国内电视节目版式保护的建议
我国对电视节目版式的知识产权不仅没有立法上的保护，也没有司法上的案例可以借鉴。而大量的电视节目版式知识产权纠纷一般是通过行政方式解决。在完善保护的过程中不仅要考虑到国内特殊国情的需要，还应当与国际惯例接轨，为我国的电视节目版式未来在全球范围内受到保护提供法律依据。
第一，立法保护。通过立法把电视节目版式明确纳入到著作权保护的范围之内，是保护电视节目版式最有效的方法。与此相配套，确定电视节目版式的内涵和外延以及创新性标准，对符合著作权法保护条件的电视节目版式进行直接的保护，明晰保护对象和侵权原则。保护期限应当考虑电视行业本身的特点和著作权保护引起的收益和成本的平衡。
第二，借鉴国外经验，通过各种组织进行保护。在国内，可以成立专门的民间组织对电视节目版式进行保护。在国际范围内，我国可以考虑申请加入国际图联即电视节目版式的承认和保护协会(FRAPA。加入国际性组织一方面可以合法与国外进行电视节目版式的贸易，充分发展我国电视产业，另外从长远来看，可以为将来我国的电视节目在世界范围内播放、贸易提供法律保护，避免我国的电视节目版式被外国电视节目抄袭和不正当利用。
