我的民法学习感悟
社会和谐的维系不仅仅是靠道德来约束，更需要是法律的来维系。每个人对道德的理解可能不尽相同，我们可以谴责，从心理上给与压力。但法律不同，它是一种被大众普遍认可的以强制执行来保证其效力的一种工具，不容藐视。
随着现代经济生活的高速发展，人们的也在与日增强。当自己的合法权益受到侵害时，法律就是我们的保护伞。法律与人们的生活息息相关，对于当代大学生而言，基本法律知识的学习成了在未来立足的一个重要砝码。加上自己一直以来对法律的热爱，我果断选择了民法这门选择课。
据《中华人民共和国民法通则》第2条从民法的对象和任务角度来看，民法是调整平等民事主体的自然人、法人及其他非法人组织之间人身关系和财产关系的法律规范的总称，是法律体系中的一个独立的法律部门。而根据《中华人民共和国合同法》第2条第1款对于合同所进行的概念界定，对民法的定意义为妥当的表述应为：我国民法是调整平等主体的自然人、法人和其他组织之间的财产关系和人身关系的法律规范的总和。民法既包括形式上的民法（即民法典），也包括单行的民事法律和其他法律、法规中的民事法律。
选修课的内容很丰富，我们主要学习了民法的概念，调整对象和基本原则，以及民事主权.物权债权知识产权继承权等重要民法制度的基本知识和基本理论。沈老师深入浅出的为我们讲述了这些内容，民法学本身是一门枯燥的学科，但沈老师给我们讲完知识会给我们案例，和我们一起分析这个案例的违法之处，有时候为了加深我们的理解，沈老师还精心为我们找了一些视频分享，体味社会百态的的同时加深了对民法的理解。我印象最深的是一个老人借小儿子钱买房子的，一审判决小儿子败诉，二审判决小儿子胜诉。这里不仅涉及遗嘱问题还涉及了合同法的内容，也给我们一个警示：要保管好遗嘱不能怕麻烦，各种证据要保存完整，更重要是兄友弟恭，莫争不该属于自己的东西。
通过学习我明白了民法是有国家强制力（区别于道德等）的社会生活规则；是调整社会生活中财产关系和人身关系（其他关系不调整）的法律规范；是调整平等民事主体之间的社会关系的法律规范；是调整社会主义市场经济关系的基本法；是一种文明法；是行为规范兼裁判规范；就其内容来说，是规定权利主体有无权利、义务的法律，属于实体法；就其适用范围来说，是施行于一国范围内的法律，属于国内法；就其效力来说，是全国范围内主体间一般通用的法律，属于普通法。
经过短短几个月的学习，我对法律的兴趣更加浓厚，我懂得了在一些情况下，有效的行使自己的权利，更好的维护自己的权益，也懂得了自己应该行驶哪些义务。最后衷心的感谢沈老师给我们传授民法知识，特别是在身体抱恙的时候依然坚持带我们遨游民法知识的海洋。虽然民法的选修结束了，但我对法律的学习不会止步，它一如既往是我的业余爱好，我的挚友。

So people call it Mountain City。 In Chong Qing，I went to the Red Stone Center， to see the places which the prisoners lived in the past。 It is a terrible and awful trip。 There are a lot of dogs， and soldiers with guns near the prisons。 And most of the prisons are good， they didn't want to tell the bad people where the other people were。 They lived in very small houses。 No good food to eat， no good water to drink。They had only twenty minutes to stay out side per day but they still said nothing。
I think they are the heros in that century。 I will follow their spirit。

洗星海生活在一个非常贫困的家庭，全家都靠打鱼为生，他一出生就没有了爸爸，和妈妈、外公相依为命。星海自小就很喜欢音乐，他用海螺、贝壳、破罐儿制成乐器，将自己只听过几遍的音乐用筷子敲打着发出很美妙的声音。后来星海非常想上学，他的妈妈曾便当手镯让他上学，可是他手当了同学们的欺负，是教书先生产生误会，而被开除。
天有不测风云，他外公出海丧生，这无疑是对他们雪上加霜。无奈之下，妈妈带着他去投奔亲戚，在姨妈的帮助下，星海又一次进入了学校，遇见了肖老师，从此勤学苦练，开始了他的音乐生涯，他边读书，边学习，终于成了一名著名音乐家，实现了他的梦想。
电影其中有一段台词让我记忆深刻，星海问肖老师；“音乐为什么那么伟大，音乐家为什么这么贫穷呢？”老师回答他的话说：“人得贫穷和富裕不是用金钱来衡量的精神也是财富。”我们想想，当你弥留之际的时候，你留在世上的金钱、权利、地位没有一样是可以带走的，唯有你在世界上创造出有价值的事物，才会永远留在世上，永垂不朽。“
看完这部影片后，我陷入了沉思。星海的'生活环境是那样的恶劣，而他却坚强不息，终于实现他的梦想。今天的我们是何等的幸福，我们的家舒适温暖，还有爸爸妈妈对我们精心的养育；我们的学校宽敞明亮，设施齐全，还有老师无微不至的关心与教育，但我们经常意志松懈，目标不明，因此，现在的我们要更加努力的学习，像洗星海一样做一个自强不息，有作为的人。

summer can be very hot in southern taiwan where the temperature usually goes up to 32"c or more. because of the heat it is a trying experience to go to school or do anything else in a place that is not air-conditioned. also because of this i stay at home most of the time during the summer vacation and only occasionally go to the beach to plunge myself into the cool water as a way to keep my body less sticky.
actually i like swimming and think nothing is more refreshing than a swim. in the summer vacation that has just ended i went swimming many times with my classmates and we all had a good time. this summer vacation, however, was not spent entirely in seeking fun. as a second-year senior student i had to prepare myself for the college entrance examinations that were only a year away. in other words, i must find time to study, too.
so i divided my time between work and play during the summer vacation and derived much benefit from this arrangement.
